1. General
1.1  The Terms apply to all services ("the Services") provided by (a trading name of OMS Services Limited; "we", "us", "our") as resources for access to genealogical and related data and products for online family history research.

1.2  The Services are provided via the following web sites and services:,,, and ("the Sites").

1.3  You may be accessing these Services through a third party service licensed by us to provide such access, in which case these Terms shall supplement the prevailing terms and conditions of that third party service provider.

1.4  Unless explicitly stated otherwise the Terms shall apply to all changes, whether temporary or permanent, made to apply to the Services. In addition, when using particular services provided through the Sites, you may be subject to additional posted guidelines, rules, and terms and conditions applicable to such services. All such guidelines, rules, and terms and conditions are hereby incorporated by reference into these Terms.

1.5  We reserve the right to alter these Terms without advance notice. You can determine if the Terms have been revised by referring to the "Last Updated" date at the top of this page. Continued use of the Services now or following posted changes in the Terms means that you have accepted and are bound by these changes.

1.6  If any portion or any change of these Terms is unacceptable to you or will cause you to no longer be in compliance with the Terms, you should not use the Services and if you are a current subscriber to the Services you may cancel your subscription by emailing us at

2. Breach of the Terms
2.1  If you breach any of your obligations defined in the Terms, we may immediately terminate your use of the Services with no refund of any subscription fee you may have paid, and if you are in breach of any law, we may take appropriate legal action and advise any relevant law enforcement bodies.

3. Individual Use
3.1  You may use the Services only for personal or professional family history research and may download content only as search results relevant to that research.

3.2  You may not download from the Sites the whole or significant portions of any work or database.

3.3  You may not resell the whole or any portion of a work or database except as specific results relevant to specific research for an individual.

3.4  You may not make any data downloaded or copied from the Sites or provided via the Services accessible via any web site without our written permission, except as items incorporated into your personal family tree or similar personal information.

3.5  You may not distribute to or share with others your login and/or password details for access to any of the Sites or Services.

4. No Warranty
4.1  The data provided via the Services and on the Sites may include inaccuracies or typographical errors and we may add, delete or amend any at any time without notice. We and our third party suppliers provide all content in the Services and Sites "AS IS", and without any warranty of any kind.

4.2  All conditions, warranties and other terms which would otherwise be implied by law are excluded.

5. Limitation of Liability
5.1  We accept no liability for any loss you may suffer as a consequence of your use of the Services or for any loss arising from your failure to comply with your obligations under the Terms.

5.2  We accept no responsibility for any loss you may suffer as a consequence of your being unable to access the Sites or use the Services for any reason not under our control.

5.3  Our liability to you for any loss you may suffer as a consequence of being unable to use the Services is restricted to the payment or proportion of any payment made by you to us which would otherwise permit you to use the Services from the date at which your claim arose.

6. Privacy Policy
6.1  Information we may hold about you ("Account Details") may be viewed by you at any time on the Sites and may include:
  • Your name
  • Address
  • Phone number
  • Email address
  • Browser type
  • Records searched
  • transactions details (no. of payments/payment times)
  • Billing address (if not same as your home address)
  • Delivery address (if not same as your home address)
6.2  We hold the information about you for administrative and legal reasons, we will only use it lawfully (in accordance with the United Kingdom Data Protection Act 1998), and we will not disclose any of it to any third parties except as required by law (eg for audit purposes).

6.3  Personal information is held securely in accordance with our internal security policy and UK law. We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from unauthorised access, improper use and disclosure, unauthorised destruction or accidental loss. We do not hold any of your credit card information on our sites; credit card and debit card information is transmitted directly from your PC to, and is held separately by, WorldPay Ltd, a subsidiary of the Royal Bank of Scotland plc, on their secure servers.

6.4  The information we hold should be accurate and up to date. If you find we are holding any inaccurate data we will delete or correct it promptly on receipt of advice from you or you may delete or correct the personal information in your Account Details by access from the Sites.

6.5  Unless necessary to resolve some problem you may have, we will not email or contact you unless you have given us your consent.

6.6  You may choose to join a mailing list to be kept informed of updates to the Sites and Services, genealogy articles and other news of interest to genealogy researchers. This mailing list not used for any other purpose.

6.7  We may send a small file to your computer when you visit our website, called a 'cookie'. This allows us to track your experience on our website and identify your particular areas of interest so that we can improve our level of service to you. We may link information stored by cookies with personal data you supply to us. The only personal information a cookie can contain is information you supply yourself. If you set your computer to reject cookies, certain aspects of the Services and Sites will not work for you.

7. Registrations/Email
7.1  You do not have to register with us in order to access some of the Services (eg the Free surname search, discussion group etc). However, to access and use other Services you will need to register and pay. For example, to use our subscription services you must provide your billing address, phone number, email address, credit card number, and credit card expiration date. All submissions of such information are governed by our Privacy Policy (section 6).

7.2  You must select your own password when you register, which you will use along with your email address to log into the Sites. You must keep your password confidential, and not share your login details with anyone else.

7.3  You must not use an email address (or "username", for anyone who registered with us before July 2003) that is invalid; that belongs to or is already being used by someone else unless you have their prior consent; or that violates the intellectual property or other rights of any person.

7.4  You will, where information is requested, provide true, accurate, current, and complete information about yourself, and maintain and update it promptly.

7.5  You are fully responsible for all activities that occur under your password and user name.

7.6  You will notify us as soon as possible if you know of or suspect any unauthorised use of your account or your login details.

8. Your Conduct
8.1  You will not:
  1. Post, transmit, or otherwise make available anything that is or may be
    (i) threatening, harassing, degrading, hateful, or intimidating;
    (ii) defamatory;
    (iii) fraudulent or tortious;
    (iv) obscene, indecent, pornographic, or otherwise objectionable;
    (v) protected by copyright, trademark, trade secret, right of publicity, or other proprietary right without the express permission of the owner of such copyright, trademark, trade secret, right of publicity, or other proprietary right;
    or (vi) in violation of another person's privacy or other rights.
  2. Use the Sites for any illegal purpose; or post, transmit, or otherwise make available any material which would give rise to criminal or civil liability, which encourages conduct that constitutes a criminal offence, or which encourages or provides instructional information about illegal activities, or activities such as hacking or cracking.
  3. Impersonate any person or entity, including, but not limited to, any Origins Network representative or another user of the Services; falsely state or otherwise misrepresent your affiliation with any person or entity; or express or imply that we endorse any statement you make without our prior written consent.
  4. Post, transmit, or otherwise make available any virus, worm, Trojan Horse, Easter egg, time bomb, spyware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment.
  5. Interfere with or disrupt the operation of the Sites or Services, or the servers or networks that provide the Sites and Services; or disobey any requirements, procedures, policies, or regulations of such networks.
  6. Restrict or inhibit any other user from using the Sites, including by means of hacking or defacing any portion of the Sites.
  7. Post, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," investment opportunity, or any other form of solicitation.
  8. Reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of the Sites and Services, use of the Services, or access to the Sites or Services.
  9. Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Sites.
  10. Remove any copyright, trademark, or other proprietary rights notice contained on the Sites.

9. Payment
9.1  You will pay all charges incurred for purchases made under your username and/or account at the price(s) in effect when such charges are incurred. You will also pay all applicable taxes resulting from your purchases. You may make payments online by credit or debit card or other payment, means which may be described on the Sites.

9.2 subscriptions (one month or longer) are automatically renewed until you cancel your account, according to the subscription period. For example, a three-month subscription is renewed after the initial three months has expired; a yearly subscription is renewed after twelve months. You can check the date of expiry of your account at any time by viewing your Account Details. You can cancel the renewal of your subscription at any time by emailing us at

9.3  You can cancel your current subscription or renewal of your subscription at any time up to 7 days prior to the date of expiry by emailing us at but no refund will be made for the unused period of a current subscription.

9.4  Unless explicitly stated otherwise, our prices include UK Value Added Tax where applicable. With the exception of books and maps – which are zero-rated for VAT in the UK - all other products and services purchased by customers based in the European Community carry VAT at the UK standard rate of 20%. Our net prices for EC-based customers (ie exclusive of VAT) are set such that those prices plus VAT are the same as the prices charged to non-EC customers. Thus the gross prices charged to every customer, wherever in the world they live, is the same, and we pay the applicable amount of VAT whenever it applies. If you require a VAT invoice for any product or service you have purchased, or have any query concerning VAT on our products and services, email us at, and include the word "VAT" in the subject line of your email.

10.  Origins Store, Origins Originals, and Origins Experts Purchases
10.1  Some Services, including but not limited to Origins Store, Origins Originals and Origins Experts, involve products and services provided by third parties (where we act simply as an agent for the third party). If you use such third party services, we will provide information about the provider and contact details on the Sites and/or in an email sent to you.

10.2  We make no warranty concerning third party provided goods or services and you must seek any recourse for dissatisfaction or problems with those goods or services from the third party provider and not from us.

11.  Copyright Statements & Disclaimers
11.1  General: Visitors to the Sites are granted permission to access the material on the Sites, including data held within databases, to download and copy such material on to electronic, magnetic, optical or similar storage media, and to make printed copies of any such downloaded material, provided that such activities and copies are for private research or study only. Visitors to the Sites may not copy, distribute, sell or publish any of the material downloaded or copied from the Sites. Any other use of the material requires the formal permission of the copyright holders. For the avoidance of doubt, no permission is given for the transfer of any of this material to an open Internet site. Except as described in clauses 11.2 and 11.3 or as explicitly mentioned on the Sites copyright in all material on the Sites including databases is held by OMS Services Ltd.

11.2  Irish Origins: Copyright in the data held in the Irish Origins database is owned by OMS Services Ltd, Eneclann Ltd, and the National Library of Ireland; copyright in the digitised "Griffith's Valuation" maps and town plans is owned by Valuation Office Ireland.

12.  Applicable Law
12.1  The Sites (excluding linked sites) and the Services are controlled by us from our head office in the UK. You may access the Sites and Services from any country around the world, each of which has laws that may differ from those in the UK. By accessing the Sites and Services you agree that English law will apply to all matters relating to use of the Sites and Services.

13.  Links to External Sites
13.1  The Sites contain links to external, third party web sites, which we provide only as a convenience.

13.2  We do not operate or control and have no responsibility for the information, products and/or services found on any external sites. Nor do we represent or endorse the accuracy or reliability of any information, products and/or services provided on or through any external sites, including, without limitation, warranties of any kind, either express or implied, warranties of title or non-infringement or implied warranties of merchantability or fitness for a particular purpose. You assume complete responsibility and risk in your use of any external sites. You should direct any concerns regarding any external link to its site administrator or webmaster. Any dealings between you and any advertisers or merchants found on or via the Sites, including payment for and delivery of products, services and any other terms, conditions, warranties or representations, associated with such dealings, are solely between you and the relevant advertiser or merchant. 14.  Modification or Suspension of Services
14.1  We may, at any time and from time to time, to modify or discontinue, temporarily or permanently, the Sites and Services (or any part thereof) without notice. We may change the amount of any fee or charge and institute new fees or charges at any time for any Service, effective upon our posting notice thereof. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services, or of any content, feature, or product offered on the Sites and Services.
